Introduction to the Rules of “What do you see from your window?Facebook Group

Hi Friends! It’s me, Arik.

When I created our Group, the rules were no more than bare bones. There were only a couple of general rules relating to content, and that was it! Then, as the Group quickly went viral, with thousands of Members joining daily. Things looked very different on the feed back then.

Since those early days, based on Member feedback and experience, in order to give the Project the positive and loving feel that it currently has, our rules changed and grew as did our Community. Over 100 rules of content were articulated and fine-tuned. The rules decide what is allowed into the Group and what isn’t.

I have invested plenty of time and thought into writing and developing the rules of the Group, with the assistance of my colleagues on the Admin Team, as well as the invaluable feedback we received from our Members. There was a need to put in place rules that define the concept and visions of our Project. Thus, with time, additional rules were added and existing rules were amended according to the Community’s needs and feedback.

Great rules are more than just a list of what’s not allowed. We have done our best to articulate rules that inform Members of what is encouraged in the Group, so they know how they can positively engage with the Community. The rules help our Members understand the expectations of our Group. We would like the rules to set the tone of our Group by listing the ways Members can positively contribute. Our rules are an opportunity to state what our Community can achieve together.

In the articulation of our rules, we have made great effort to inform Members what they can do, and not just what they can not do. From our experience, this leads to a more positive tone in our Community, overall.

We also use our rules to help set the tone for our Group and assist with prevention of Member conflict. These rules are designed to help build our Group’s peaceful culture and provide a feeling of safety for all of our Friends.

Our Group’s name is “What do you see from your window?”. Accordingly, one could expect that only photos showing views taken from windows would be allowed, but that’s not the case.

The Group was created on 21 March, 2020, at the beginning of the Coronavirus Pandemic Lockdown. At the time, everyone had to stay at home. However, since then, many countries entered opening phases. As the situation in the world was getting better, we kept our hashtags current: #OpeningUp. Accordingly, we also allowed an opening up of the type of content that is permitted into the Group.

In our Community, we don’t take “window” literally. For us, it is an opportunity to look through a transparent opening and see what is on the other side, in our hearts and souls. Our windows help us understand each other.

As a rule of thumb, without getting into all the details, if you wish to submit a post, it is most likely to get approved if it shows an outdoor view, not zoomed-in, of your own personal creation, with your country added to the text, and without any controversial content.

Opening up our Group to more than just window views, still doesn’t mean that just anything may be posted, so we created a set of rules that would guide the concept of the positive, friendly, supportive and International Community that is our vision.

Our set of rules is long and we understand if our Members are too busy to read them. Still, there is another way to get acquainted with them. We welcome our Members to share on the Group as they wish. Each and every post submitted is reviewed and evaluated by a Moderator before it gets published. So, after a Member submits a post, a Moderator will evaluate it according to the rules. They will approve it if it’s valid and disapprove if non-valid. When a Moderator declines a pending post, the Member is given an explanation of the reason. This process of providing our Members with the reason for disapproval will allow them to correct their post and submit a valid one.

We ensure transparency and accountability with regards to our rules. How do we accomplish that?

First, our rules are available online on this page below, and any Member may read them.

Second, our Admin communicates the most important rules and major changes by posting to the Group.

Third, when we decline or remove content in our Group, the Member is given an explanation of the reason for the disapproval, thus allowing the Member to understand the rules.

Rule 1

Forgot to add a photo?
Your post has text only. Let’s refrain text-only posts. You’re invited to add a photo to your text and repost. That would normally solve the issue and get your post approved. Inspirational and travel related text posts may be occasionally permitted.

Rule 2

Indoor Photos
No indoor photos unless a window is shown with clear view. Travel related indoor photos of historical & cultural sites may be approved at Admin’s discretion in some cases, as befits the site’s concept.

Rule 3

Add Country. Where was the photo taken?
Please write or tag the country where the photo was taken on your post. Everybody’s curious! We invite you to add your country and repost.

Photos Showing People’s Faces
Let’s refrain from photos showing faces of people.

Rule 5

Photos Focused on Domestic Dogs and Cats
Domestic dogs & cats on photos is ok, but the photo should have wider view. No close ups or portrait posing. If the animal is by a window or outdoor & not zoomed in, the post is more likely to pass

Rule 6

Recommendation about Photo Galleries
We recommend you submit photos one by one, instead of a gallery. When several photos are shared at once, one invalid photo might cause the whole post to be declined. You’re welcome to repost.

Rule 7

Sharing from Personal Profile
Upload content directly to the Group. Refrain from sharing content from your own personal profile. We invite you to repost the same content directly to the Group, without using the “share” function.

Rule 8

We can’t see your post

Frequency of Posting
Each individual Member is welcome to submit a maximum of 2 posts per day. Excessive posts will be declined. *

Rule 16

Let’s stay positive
This environment is welcoming. When we can’t say something positive, we don’t say nothing at all. No arguments. Discussing controversies is important too, but here it’s just not the place. We keep it kind, safe & positive.*

Rule 17

Commercial, Personal & Self Solicitation
Posts shouldn’t include commercial, personal & self solicitation or promotion (including restaurant names, etc). *

Rule 18

Editing Posts After Publication
Refrain from editing posts after Moderator approval with content that breaches the Rules. Doing so might lead to Member removal. We advise Members not to edit their posts after publication.

Camera and Phone Brand Names on Posts and Photos
Refrain from including camera and phone commercial brand names on posts and photos (including brand stamps on photos).

Rule 20

Referring to Hotels and Vacation Rentals
Refrain from referring to, or mentioning names of, hotels and vacation rentals.

Rule 21

No Nudity and Scanty Clothing
We restrict the display of nudity on the Group because some people in our community may be sensitive to this type of content. The same applies for scanty clothing. *

Books
Books on photos is fine, but the photo should have wider context. Title & content of the book should not appear. No zoom-ins. Photos outdoor or showing clear & large window are more likely to pass. Refrain from mentioning book titles.

Photos of Maps
Refrain from photos of maps. We let people know where we’re from by stating our location in the body of the post. On photos, we would love to see your window and lovely outdoor scenes.

Food & cooking on photos is fine, but the photo should have wider context. No zoom-in photos. Photos outdoor or showing clear & large window are more likely to pass.

Limitation of Liability
To the maximum extent permitted by applicable law, the Group entities (which refers to the Group, its admins, moderators, creators, owners, affiliates, related companies, representatives, partners) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Group; (ii) any conduct or content of any third party on the Group, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the Group; or (iv) unauthorized access, use or alteration of your transmissions or content.

We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share on the Group (including offensive, inappropriate, obscene, unlawful, and other objectionable content).

In no event shall the aggregate liability of the Group entities exceed the greater of fifty u.s. dollars (u.s. $50.00) or the amount you paid the Group, if any, in the past six months giving rise to the claim. The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not the Group entities have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. *

Procedure for Making Claims of Copyright Infringement
We respect the intellectual property rights of others and expect Group Members to to do the same. We will respond promptly to claims of copyright infringement that are reported to us.

If you are a copyright owner and have a good faith belief that your work’s copyright is being infringed, you should submit a written notification to info@fromyourwindow.com that includes: (a) your contact information, including your name, address, telephone number, and email address; (b) identification and description of each copyrighted work that you claim has been infringed; (c) the exact URL or location of the material that you claim is infringing; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (e) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and (f) a statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owners. Upon receipt of a bona fide infringement notification, it is our policy to remove or disable access to the infringing material, notify the user that we have removed or disabled access to the material and, for repeat offenders, to terminate such user’s access to the Site.

Any information or correspondence that you provide to us may be shared with third parties, including the person who provided us with the allegedly infringing material.

If you believe that your content should not have been removed for alleged copyright infringement, you may send to info@fromyourwindow.com a written counter-notice with the following information: (a) identification of the copyrighted work that was removed, and the location on the Site where it would have been found prior to its removal; (b) a statement, under penalty of perjury, that you have a good faith belief that the content was removed as a result of a mistake or misidentification; and (c) your physical or electronic signature, together with your contact information (address, telephone number and, if available, email address).

If a counter-notice is received by us, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our discretion. *

Rule 117

Use of Computerized Tools to Detect Previously Published Online Content

In our Group, Members are encouraged to share authentic and original content that they created themselves. The vision of our Community is one in which Members provide a window to their worlds and to their hearts, which is personal and authentic. Stock photos are beautiful too, but in our Group, it’s just not the place to post them.

To keep the Group loyal to its nature, the Admin Team will be entitled to use third-party computerized and digital tools to detect stock and previously published online images. If the Moderator sees a photo awaiting approval on the pending list, that the Moderator may suspect to be stock or unoriginal, the Moderator will have the right, at their sole discretion, to run it through software that alerts whether the photo was previously published online or not. By joining our Group and sharing content in it, Members agree, approve, give their consent and permit the Admin Team to have their content examined through such digital means, in cases deemed necessary by Admin. With this information, the Moderator will be able to decide if the post is to be approved or declined. When Admins discover Members who repeatedly violate this rule, they might remove and block the individual from the Group.

If we’ve missed any images suspected to be stock, we invite Members to use the “Report post to group admins” function, to let us know about it. This is also of great help.

In addition to photos, we are also sensitive to the issues of copyrights regarding recorded music, quotes, and other related subjects.

Through our work of Group Moderation, we invest much time and effort in protecting copyrights. Such respect is required to honor the original creator of the work, as well as essential in keeping the loving, authentic and personal spirit of our Community.*

Rule 118

Jurisdiction and Applicable Law
The Rules of the Group and anything related to the participation in it, will be governed exclusively by the laws of the State of Portugal. The courts of Lisbon will have the exclusive jurisdiction in all that relates to it. *

Rule 119

Notwithstanding
Also, notwithstanding the sections above, to promise the Group’s viability, some photos that include the Group shop’s window-souvenirs, as well as links in the posts and commercial promotion and solicitation, may be permitted to be published on the Group in particular cases at admin discretion. *

Rule 120

No Obligation to Enforce
Notwithstanding the sections above, the final decision if to approve content in the Group or not, and if to allow exceptions to the rules, is of the Admins, at their sole discretion. Admins shall not be under any obligation to, or liable or accountable for any failure to, enforce the rules. *

Rule 121

Rules Amendment
Admins reserve the right to alter, update or change these rules at any time.*
